Summary/Abstract: During the state of the COVID-19 epidemic, restrictions were imposed to reduce the spread of the disease in Poland. Inter alia the freedom of economic activity was limited. Articles 22 and 31 section 3 of the Constitution of the Republic of Poland, constitute that these restriction is acceptable only by act of law and due to important public interest. These restrictions cannot violate essence of freedom and rights. This violation was committed by imposing a injunction of economic activity in ordinance. Analysis of the above articles and jurisdprudence allows to make a hyothesis that this restrictions were unconstitutional.
