Protection of the marine environment as a component of freedom of navigation: a paradigm shift in action in leisure, recreation and water sports

Summary/Abstract: This article considers whether the freedom for any person to navigate at sea for leisure purposes still constitutes, with regard to measures protecting the environment, a cornerstone of the freedom of navigation or if the „environmental value” constitutes a new principle, which, like the safety of navigation, becomes an element of the freedom of navigation. The study of marine natural parks suggests that environmental protection has become a component of the freedom of navigation.
