Summary/Abstract: The value of the claim is the 2nd part of the Trilogy that began in 2017 with “The Moment of the Claim's Birth”. Beyond its textbook definition in civil law, a claim is an abstract concept that functions adequately without the need for precise comprehension. In routine disputes, grasping the fundamental essence of a claim is often deemed irrelevant; the focus is typically on the timing and amount of payment, rendering it a theoretical concern with no practical bearing. However, collective proceedings disrupt this complacency. Creditors vie with one another to maximize their recoveries, while debtors strive against all to retain something for themselves. “The Value of the Claim” explores the disparity between a claim's nominal and actual value. It elaborates on how this value is established, including the pitfalls that lead to overly optimistic projections during planning phases and failures in execution. This study doesn't aim to deliver an exact formula for determining a claim's real value but instead proposes a framework capable of generating such a valuation. The act of filing claims in the creditor's pool marks merely the initial phase of the debtor's business rescue process. The accuracy of these claims' interpretation is key to achieving success.
