On the utility of the “company interest”

Summary/Abstract: To verify the usefulness of the notion of “company interest” or “social interest”, the search begins in the jurisprudence of company law. There it can be observed that the social interest prevails in corporate law disputes. As a rule, it is appreciated by the judge a posteriori and, for this reason, it is recognized as the police of behaviors in the company: the behavior of associates and administrators.
