A BRIEF ANALYSIS OF THE OFFENCE OF UNLAWFUL USE OF SPECIAL MARKING DEVICES

Summary/Abstract: In the permanent preoccupation of amending the criminal legislation, of the attempt to correlate the criminal provisions of the special regulations with those of the Criminal Code, the legislator also made some less inspired changes. One of these is the erroneous repeal of the offense of unauthorized use of special marking devices, provided for in art. 112 of the Forestry Code, in the context of the non-existence of a correlative offense in the Criminal Code. It took 5 years for the legislator to realize the error and reintroduce it, as an offense, to art. 1071 of the Forestry Code.
