Summary/Abstract: The criminal practice has given rise to many thorny issues concerning prescription, which have acquired different solutions through the majority doctrine. In the present study, we will present how the latest decisions on the prescription of criminal liability have been put into practice against the provisions of the fundamental law, the criminal law, and finally the principles governing mitior lex.
