Summary/Abstract: In the author’s opinion, sole proprietorships employing staff solely on the basis of mandate contract or another civil-law contract, may bid tenders in the public procurement proceedings. Moreover, it is not permissible to require from an entrepreneurs to employ their workers on a contract of employment basis. This conclusion follows form the fact that the legislature intentionally uses in the Article 22 of Public Procurement Law Act very capacious word “dispose of the persons” and avoids the word “employee”.
