Factual and legal opinion on the draft concerning the directive of the European Parliament and of the Council on the use of Passenger Name Record(...)

Summary/Abstract: The opinion concerns the draft of the EU directive concerning the use of Passenger Name Record. The draft provides for the obligation of the airlines of collecting and passing to the member states authorities the data of each flight of all the passengers (Passenger Name Record – PNR). That information should be used only to prevent the terrorism and in the investigations of terrorist offences. The author presents doubts connected to this draft, e.g. whether it is necessary to create another base of personal data and the problem of the right to privacy. In the author’s opinion, the draft is consistent with the principle of subsidiary. In conclusion the author says that the draft needs to be clarified and precised in order to better protect the fundamental human rights.
