Summary/Abstract: The article presents a brief statement of the nature and meaning of the European Investigation Order, as well as the nature and meaning of the principle of mutual recognition of judicial decisions. Based on the presented brief analysis, the author sets out her thesis, how an EIO for search and seizure should be implemented in practice in the territory of another EU member state in the pre-trial phase of the process, with the emphasis being placed on the question whether a warrant for search and seizure should be received from the court in the executing state as well.
