Summary/Abstract: The article presents selected regulations of Polish criminal law (also from a historical perspective) relating to the regulations of criminal liability related to the time of war. Some of these regulations were established as a consequence of the war, and their purpose was in particular to regulate the issue of criminal liability for behavior undertaken during and in connection with the war. Others were introduced “in case” of war so that they could only be updated in a war situation. The concept of time of war can be found in the provisions of Polish criminal law (especially military criminal law) as a hallmark of types of crimes – as a modal circumstance of the time of committing the crime and as a qualifying hallmark, determining a more severe punishment.
