Summary/Abstract: The installation of audio-video surveillance systems in school units pursuant to Article 66 of the Law on Pre-University Education does not take into account the provisions of the GDPR, nor the recommendations of the EDPB guidelines on video surveillance, employee monitoring or validly expressed consent. Provisions such as majority consent, justifying requests for access rights, introducing parental consent as part of the educational contract, lead to the need to revise the said article. It is necessary to analyze the case of the individual school unit, criminal history or violence as well as the application of less intrusive measures for private life before installing audio-video surveillance systems in classrooms.
