Summary/Abstract: The 21st-century industrial revolution is digital and the digital economy is increasingly shaped by artificial intelligence. Intellectual property plays a crucial role in fostering innovation by providing support and incentives to creators worldwide. The progress of our society is largely determined by our ability to generate new ideas and introduce ground breaking inventions to the market. However, with the rapid rise of artificial intelligence systems, especially Generative AI, a new wave of opportunities and challenges has emerged. One of the central issues is determining the ownership of AI-generated content. Legal systems around the world are still grappling with this question. Detecting and addressing AI-generated copyright violations can also be challenging. AI is increasingly being used to assist in the patenting process, from prior art searches to generating patent claims. This raises questions about the quality of patents, as well as the role of AI in innovation and invention. The ethical implications of AI-generated content can and should impact IP law discussions. It’s important to note that the legal landscape regarding AI and intellectual property is still evolving, and laws and regulations may vary from one jurisdiction to another. As AI technologies continue to advance, legal systems will need to adapt to address these complex IP issues and provide clear guidelines for ownership, protection, and enforcement.
