Summary/Abstract: Globalization as an outstanding phenomenon of the present times synergizes not only positive tendencies and events, but also negative processes. State as a form of the society organisation is not allowed to resign to the regulation and minimisation of negative impacts on those who did not cause them and bear no responsibility. Regardless the political leadership governing a state, the state itself should fulfil the functions that in a generally positive way influence (through the legal procedures containing inevitable moral content) the general atmosphere within the society and has to motivate the addressees of law towards positive behaviour.
