Relationship of Democracy and Professionalism in Local Administration of the Slovak Republic

Summary/Abstract: The presented article analyses the constitutional and legal aspects of democracy and professionalism in the field of local administration. It primarily draws its attention to those aspects which seem to be the most controversial ones within Slovakia when confronting the legal dimension and practice. Following this idea the author of the article tries to explain the clash between democracy and professionalism which might occur in the designation and execution of the function of municipal units. Further on, he examines the demands regarding the proper municipality mayor’s professional education and training as the potential legal condition of the execution of their post. Besides that he analyses the compliance between the mayor and the municipal assembly, especially when taking the execution of the law of mayor’s veto into consideration being enforced by the municipal mayor as well as their possible recalling from the post by means of the local referendum initiated by the municipal assembly. The author suggests and puts forth some prospective solutions of the existed problems by means of presenting proposals de lege ferenda in the field of legal amendment concerning the local administration in the Slovak Republic. The author’s conclusions are based on the theoretical conceptions concerning the territorial administration, V4 experience and know-how, and requirements arising from the demands of practice.
