Summary/Abstract: In this article we set out to address the issue of discrimination from the perspective of the procedural act. Discrimination is not an easy matter to prove, sometimes being very difficult or even impossible. The best way to resolve such a complaint is to bring as much evidence as possible. Whether it is witnesses, documents or other evidence, it is extremely important that all of this can be used in arguing the case. The more evidence there is, the easier the case can be tried and solved.Discrimination does not tend to manifest itself in an open and easily identifiable manner. Proving a case of direct discrimination is often difficult, even if, by definition, the differential treatment is „overtly” based on a characteristic of the victim.
