Structural unit of special investigative measures: doctrinal approaches and regulations

Summary/Abstract: In recent times, law enforcement agencies have gained considerable experience in applying legislation on special investigative activity in the fight against crime. This experience has both positive and negative aspects. The positive aspect is the active use of the results from special investigative activity in the criminal procedural evidence. The negative aspect entails distrust and critical assessment of the outcome obtained through special investigative measures. Moreover, the legislation on special investigative activity contains multiple contradictions, uncertainties, vagueness and loopholes, which substantially hinders its proper application and enforcement. We are aware that in recent years many publications have emerged on various aspects and issues related to special investigative measures. At the same time, there is also a lack of complex works on operational-investigative activity, particularly in terms of their structural unit. With this article, we have made every effort to close this gap. As a study focused on the field of special investigative measures, the article outlines the results of substantial research on the essence, regulation, particularities and structural unit of special investigative measures.
