Summary/Abstract: The dynamics of number of drivers, who drive motor vehicles under the influence of addictive substances, has increased constantly during the last years. In practice, there are many problems consisting in judging the legal responsibility of drivers driving vehicles under the influence of addictive substances other than alcohol. In judging the responsibility for this behavior it is necessary to proceed systematically, i.e., at first to exclude that the driver committed a crime, then to judge whether the driver committed an offence or whether any illegal act has been committed at all. The objective of the contribution is to point out the application problems arising in judging the legal responsibility of drivers under the influence of addictive substance other than alcohol and to propose solutions of this issue. For the purposes of achieving the objective, research and content analysis of literature will be carried out. In addition, analysis of legal provisions concerning this issue will be carried out by means of historical comparison. Moreover, findings from the application pwill be used.
