Summary/Abstract: Following the legislative path of Law no. 8/2006 regarding the establishment of the allowance for pensioners of the public pension system who are members of creators’ unions legally constituted and recognized as legal persons of public utility, republished, we have noticed many elements of superficiality, manifested during this journey by those called to enshrine a legislative system with simple formulations capable of promoting and defending human rights and not leading to controversial interpretations from courts of various instances, which ultimately remove these rights. In the following, I intend to contribute, at least theoretically, to explaining and understanding such approaches, hoping that they will reach those concerned.
