Summary/Abstract: On July 2, 2008 the European Commission, taking advantage of legislative initiative under Article 293 of TFUE (Treaty on the Functioning of the European Union) presented to the European Parliament and the Council the draft directive on the exercising patient's rights incross-border provision of healthcare. The draft, after quite a long waiting period, was adop- ted by the Council of the European Union during its summit on December 16-17, 2010. A compromise on the final form of the directive was reached there. Subsequently, the European Parliament and the Council of the European Union adopted the final version of the draft on March 9, 2011. The aim of the directive, which has its beginnings in judgements of the European Court of Justice, is to establish a transparent framework for cross-border provision of medical services within the European Union and to establish high standard health care, which, at the same time, would be efficient and safe.
