Enforcement of administrative decisions establishing the obligation of the Government to adopt administrative acts

Summary/Abstract: The study aims to analyze the execution of administrative contentious decisions, which establish the Government's obligation to adopt administrative acts, from a normative, doctrinal and jurisprudential perspective. The provisions of the Law on administrative litigation no. 554/2004 are analyzed, in the context of the provisions of the Romanian Constitution, the jurisprudence of the Court of Justice of the EU and of comparative law, from the perspective of the decisions of the Constitutional Court and the jurisprudence of the Romanian administrative courts. The doctrinal opinions, expressed in the Romanian and foreign legal literature, are highlighted, which are meant to better understand and apply the topic, especially the issues that generate controversy in the application of the provisions of the law on administrative contentious.
