Summary/Abstract: The article is based on the assumption that the grounds for the indemnity settlement procedure of the loss discussed in the paper may be sought only in a situation in which as a result of a road ac- cident the vehicle has been damaged and not destroyed (i.e. when there are no premises to qualify the loss in the vehicle as the so-called total loss). According to the assumptions made, however, not every type of vehicle damage may be subject to the loss indemnification.
