Summary/Abstract: The present study brings to the spotlight the situation of the transfer of the family medicine practice through succession, as well as the assumptions related to this transfer frequently encountered in the activity of notary offices and courts of law. The Order of the Minister of Public Health no. 1322/2006 represents the main landmark used as basis to consolidate the relationships involving the transfer of family medicine practice between living persons as well as through succession, either legal or testamentary. As it will be observed throughout the entire study, the analysis considers the transfer of an atypical patrimony of affectation both by the purpose for which it was established, by its temporality, and by the method in which the continuity of the medical service is achieved, being in fact a link between the quality of the former holder and the current successor.
