Summary/Abstract: In the Member States of the European Union, national legal systems regulate in different ways when courts must act on a motion or ex officio. It is therefore worth examining what obligations the CJEU case law imposes on national courts in this regard.In this study, we will examine only cases where both administrative and criminal proceedings have been instituted.
