Vivre d’amour et d’eau fraîche? Considerations regarding the necessary preliminary formalities for the conclusion of marriage in private comparative law

Summary/Abstract: Marriage, considered by the French professor Jean Carbonnier to be a „fundamental and fascinating” institution, has always been a source of inspiration for specialists in various fields. Being on the border between the sacred and the profane but also at the crossroads between the branches of law, it continues to be of interest to the public, as it is the main source of the family. We say about marriage that it represents the symbol of the union between the sexes, namely that it provides the framework and conditions necessary for procreation. Despite the legislative fissures, this institution remains fascinating thanks to the ambiguity of the term itself, marriage denoting both the ceremony or celebration itself and the status of the spouses once they have overcome the formalities imposed by the legislator. In the article we will debate the institutional formal conditions necessary to conclude the marriage, presenting the strengths but also the shortcomings contained in the legislation of countries such as Romania, France, Germany, or England.
