Summary/Abstract: This article aims to critically analyze some of the problems that arise from a recent orientation of judicial practice regarding the interpretation of the notion of irregularity of the indictment act in the pre trial chamber procedure, when this act contains references to evidence declared illegal in this procedure, starting from a case recently brought before the High Court.
