Summary/Abstract: The Polish Insurance and Reinsurance Act introduced a mechanism for rescinding / withdrawing from investment-type life insurance contracts. Although certain low points of this regulation were eliminated already at the legislative stage, the Act’s final version rises serious concerns about its constitutional- ity and, in particular, may be assessed as violating the principle of proportionality. One of the drafters’ key mistakes is the promotion of the concept of “moral hazard” affecting customers of insurance un- dertakings. The new piece of legislation introduced a cooling-off period for long-term insurance con- tracts, a measure that effectively transfers the risk of a contract’s premature termination to the insurer.
