Summary/Abstract: Article 18 of the 2015 Insurance and Reinsurance Activity Act has been a source of numerous controver- sies since the day of its adoption. One of those controversies is the issue of establishing a precise circle of recipients of a prohibition to remunerate policyholders in insurance on someone else’s account. The purpose of this paper is to answer a question whether the said prohibition is also aimed at insurance agents who act on behalf of insurers. The Authors present both pro and contra arguments on including agents within the scope of article 18. The said problem is vital to the functioning of group insurance following the entry into force of the 2015 Insurance and Reinsurance Activity Act.
