Summary/Abstract: Directive 2019/1937 on the protection of persons who report violations of Union law introduces the obligation to apply the legislation on the protection of whistleblowers and legal entities under private law that have at least 50 employees. The person who acquires the status of whistleblower in the public interest is protected against possible professional or personal sanctions to which he could be exposed as a result of submitting a notification. Law no. 361/2022 dedicates article 26 to the conditions regarding the disciplinary investigation in the case of the employee, public interest whistleblower, for a better protection of his right to defense. The law imposes on the authorities, public institutions, other legal entities under public law or legal entities under private law, the obligation to invite the press, but it also gives the right to free legal assistance to those under disciplinary investigation
