Summary/Abstract: The subject of this article is an attempt to present the legal situation of national and ethnic minorities, with particular emphasis on the multicultural region of Silesia. The aim of the study is to showcase the cultural heritage of Silesia and to consider whether the Silesians can be recognized as an ethnic minority. The article provides a synthesis of reflections on Silesia as a nation based on the Constitution of the Republic of Poland and the Act of January 6, 2005, on national and ethnic minorities, as well as on regional languages, to determine whether the Silesians can be regarded as a minority. The article analyzes the concepts of national and cultural heritage, identifying their connection to identity. The fundamental law of the Republic of Poland indicates the notion of national heritage and protects the culture, traditions, and language of national and ethnic minorities. Silesian identity is manifested through the preservation of its own culture, traditions, and language, which constitutes a significant aspect of Silesian identity. However, despite having a distinct cultural identity, the Silesian community is not covered by the Act on national and ethnic minorities, depriving them of fundamental legal guarantees for minorities.
