Summary/Abstract: The family has always been the basic cell of social life. The aim of this research is to point out some very important theoretical issues and how and to what extent they have been implemented in positive European legislation. Bearing in mind the aforementioned, the work is divided into two parts, the first of which deals with theoretical issues, starting with the consideration of the theory of sociological orientation, and at the end of this part, looking at aspects of feminist explanations. In the second part of the paper, the most important international documents on protection from violence in the family, in marriage and partner relationships were considered through the United Nations, the Council of Europe and the European Union.
