Summary/Abstract: In recent years, the postulate to unify the lower age limit for criminal responsibility and the upper age limit for mandatory defence has gained strength. This article aims to assess the legitimacy of this postulate. The conducted analysis goes beyond the framework of criminal law and proceedings and refers to civil law, in the field of legal capacity and tortious capacity. The study considered the psychological approach to the juvenile’s abilities and practical experience of the juvenile’s functioning in court proceedings.
