Summary/Abstract: The author shares the position of the District Court that giving instructions by the court, as provided for in Article 5 of Code of Civil Procedure is justified in the situation where a party is unable to understand the essence of the proceedings or to take appropriate procedural steps. The court’s instructions should be determined by a justified need and the necessary nature of the instructions. The court may exercise this right only in exceptional circumstances, taking into account the specific nature of the case, the characteristics and intellectual capacity of the party or participant and the necessary participation in the proceedings in a manner which does not breach the principle of equality, as well as the opportunity for the party or participant to express his or her point of view on the case.
