The evasion of the constitution as the basis for constitutional’s responsibility

Summary/Abstract: Evasion of the constitution in the legislative and executive law process is one of examples constitutional’s crisis in Poland. The aim of the paper is to answer the question: whether evasion of the constitution can be the basis to responsibility for constitutional’s tort. First, the author defined the term “evasion of the constitution”. Next, he analysed Articles 198 section 1 Constitution of the Republic of Poland and explained what is the constitutional’s tort. He described basic rules which are in force in constitutional’s responsibility system in Poland. As an results the author ascertained that evasion of the constitution can be the basis of responsibility for constitutional’s tort. Evasion of the constitution is one of the guise violation of the constitution. In the article used the dogmatic-law method.
