Summary/Abstract: The purpose of this article is to define the relation of the claim to personal rights and to answer the question of whether the content of the claim which initiates the canonical process for the annulment of marriage may infringe on personal rights under the Civil Code. Personal rights are values protected by law that are enjoyed by every person. Legal regulations related to them can be found in the Civil Code, they contain an open catalog of personal rights, and they are protected in the event of unlawful infringement. A marriage is favored by the law, however, if for some reason the spouse finds that the marriage contracted by him is invalid, he has the right to explain his situation, and start the process for annulment. It may happen that the defendant does not agree with the content of this complaint and the description of its person presented there, it may decide that the content of the plaintiff’s complaint infringes its good name, one of the values protected by personal rights, and will bring an action to a state court for infringement her personal rights. The article contains an assessment of whether it is possible to bring such an action and its legitimacy on the basis of canon law, Polish law and judgments of Polish courts.
