Summary/Abstract: This paper examines two decisions in which the legal dispute was focused on whether it was lawful to possess coca leaves by indigenous peoples to practice rituals according to their traditional customs. Both ILO Convention 169 (ILO C169) and the International Covenant on Civil and Political Rights (ICCPR) were paramount in justifying a cultural defence.
