Summary/Abstract: The growing practical multiplication and diversity of international (legal) subjects in specialist actors that appear in international life sets demands for intensive development of both doctrine and international legal practice in the coming years of the 21st century. The status of the state in international law has been largely redefined and conditioned by transnational flows per se, as well as by the development of the practice of international (non-governmental) organizations, multi(a)national corporations, but also due to changes in the status of individuals. In this regard, we are interested in the basic rights and duties of states more as a basis for the further development of international public law and state legal subjectivity, and not as a set of anachronistic norms that have been inconsistently violated by a large number of states for many decades. Will the position of the state, and in this connection the category of basic rights (and duties) of the state evolve, and will international law be able to institutionally ensure the development and application of legal norms - ius cogens - are some of the questions we are considering in this age.
