Summary/Abstract: Bosnia and Herzegovina as a country is still being constituted. Instead of finding a "one-size-fits-all" vision, responsibility, value system, identity, tolerance and dignity of man and citizen, there are different interpretations of its legal nature, form of state organization, government and political system, especially causes, characters and consequences. "tragic conflicts in the region", about which it is necessary to objectively determine the truth and reach agreement in terms of determining the final model of Bosnia and Herzegovina as a state. The constitutionalization of the constitutional institute of the constitution of the people and the constitutional position of citizens and groups of "Others", as well as the possible scope, content and character of constitutional changes in terms of the judgment of the European Court of Human Rights, which creates an obligation for Bosnia and Herzegovina to amend its constitution and electoral legislation aimed at eliminating discrimination based on any capacity or status. This includes constitutional and all other assumptions for the equality and equality of "Others" according to the standards and criteria guaranteed by international, regional and internal documents. However, all this does not require a change in other constitutional provisions that would call into question the existing constitutional and legal system of BiH, based on the Dayton decisions and the established principle of representation of the constituent peoples and the "Others" in government bodies and institutions at all levels, which, among other things, represents the condicio sine qua non of its existence, sustainability, stability and development.
