The GDPR, regulating the protection of personal data of EU citizens, introduces several principles that must be respected when processing data, and the principle of equity is essential to ensure a balance between the rights of the data subject and the interests of the party performing the processing. During enforcement, personal data of the debtor are collected and processed. This data may include financial information, addresses, assets owned or other details relevant to the proceedings. Thus, it is vital to ensure that this data is treated in a fair and transparent manner, without prejudice to the rights of the individual. In conclusion, the integration of the equity principle of the GDPR into enforcement proceedings involves a delicate balance between the need to collect and process data for the purpose of satisfying a debt and the obligation to respect the debtor's privacy and data protection rights.
