Summary/Abstract: In the commentary, the author analyses the judgment of the Voivodeship Administrative Court in Kielce, which stated that “the school principal cannot be obliged to inform about the basis of the decision made by (...) the student council in the form of access to public information”. While agreeing with this court decision, the author elaborates on the question whether the student council is part of the school as a public authority; whether, on this basis, its activities are subject to the public information; and whether the school council may be represented outside by the principal of the school where this student council exists. Therefore, by carrying out the dogmatic (linguistic and logical) analysis of the current norms, literature, and the ruling itself, the author comes to the conclusion that the student council is a body separate from the principal of a public school, and therefore the principal cannot represent it outside. That is why, in the author’s opinion, the information about the activities of the student council is not a public information. The author in his gloss extended the topics the Court has signalized in its judgment, hoping to contribute to the scientific knowledge of the issues that have been so far rarely analyzed.
