Summary/Abstract: Unlike the majority of criminal offences from subsidiary legislation, providing veterinary medical assistance without possessing appropriate professional qualifications is not included in new Criminal Code of the Republic of Serbia that entered into force on January 1st 2006. Instead, it remained in the Law on Veterinary Medicine, which here appears as the source of so – called subsidiary or secondary criminal legislation. This criminal offence represents a serious form of harming and threatening not only of dignity and integrity of veterinary profession, but also of life, health and welfare of animals. Regardless of that, neither in theory nor in practice do the experts give enough attention to legal aspects of this negative but frequent phenomenon. That is the reason why the author of this paper attempts to present, explain and critically analyze the term and fundamental characteristics of this criminal offence as well as the punishment prescribed for its perpetrators in current legislation of the Republic of Serbia. Moreover, the author point out some particularly disputable issues related to this criminal offence such as: its name, its position in criminal legislation and the nature of social values this incrimination is intended to protect. Finally, lookin up to some of the countries from this region as role models, the author also suggests some alterations of the existing legislative solution, which would contribute to a more efficient prevention, sanctioning and oppression of this form of crime.
