Medical Immobilisation as Impairment of Bodily Organ Functions Within the Meaning of the Polish Criminal Code: Implementation of the Proposed Method of Judicial and Medical Evaluation

Summary/Abstract: The use of medical immobilisation for some injuries can make it difficult todetermine whether these impaired the function of a body organ for up to seven daysor more. The publication presents the possibility of using in practice the method offorensic medical opinion created by the authors, which concerns the legal and penalqualification of bodily injuries in cases of medical immobilisation in patients suffer-ing such injuries when it is necessary to carry out a follow-up medical examinationto determine whether such impairment of bodily organ functions caused by injuriesother than those specified in Article 156 of the Criminal Code lasts up to seven daysor longer. The article uses forensic medical opinions formulated by the authors incases concluded with valid court verdicts. If the nature of the injury does not make itpossible to determine whether it impairs the function of an organ of the body for moreor less than seven days, and immobilisation was ordered as part of the treatment, theperiod of immobilisation should not be equated with the period of organ dysfunction
