Summary/Abstract: The right of communication to the public has a complex structure and always transforming, like prof. Viorel Roș, PhD. A leading figure of the intellectual property law, prof. Viorel Roș, PhD, highlights the guaranty of human, professional and didactic quality and authenticity, impressing by intelligence, the magnitude of his knowledge and dedication. Basically, it is impossible not to be impressed by the almost fascinating power of the clarity of the speeches and the written works, on one hand, and, on the other hand, by the simplicity of the man whom I consider best described by Balzac’s affirmation “happiness is made by courage and work”. The right of communication to the public is one of the most important patrimonial rights of the authors, performers, producers of phonograms and image storage and of the radio and television broadcasting organizations, being therefore acknowledged and regulated for all the categories of right holders. The study analyses the evolution of the right of communication to the public and to making available to the public by reference to the international treaties and conventions and to the European Union directives in the field of copyright and the related rights. As regards Romania, the study tackles the analysis of the right of communication to the public of the musical works and of phonograms.
