Legal protection of traditional cultural expressions

Summary/Abstract: Cultural heritage and culture are at the heart of current concerns about individual, community and national identity, international and national cultural exchanges and the diversity of creations globally. The distinct and diverse qualities of the world's multiple cultural communities are threatened by uniformity resulting from new technologies and the globalization of culture and commerce. The Intergovernmental Committee for Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC), established in 2000 by the World Intellectual Property Organization (WIPO-WIPO) analyzes this situation based on information, comments and observations sent by committee members about national experiences, examples and legal analyses, in order to produce documents necessary for the elaboration of a practical guide on the legal protection of traditional cultural expressions (ECT) and, if possible, of an international treaty. This study summarizes the Committee's preliminary legal analyzes regarding the protection of folklore.
