ACCESS TO PUBLIC DOCUMENTS AND THEIR PROTECTION PERSONAL DATA IN KOSOVO

Summary/Abstract: The right on privacy and freedom of information are both fundamental human rights in a modern society. These two rights are most of the time interdependent and complement one another to make institutions responsible in relation with citizens. Privacy and freedom of information are sourced from the Constitution of the Republic of Kosova and are empowered through the Law on Personal Data Protection and the Law on Access to Public Documents. Privacy and the right to be informed are often described being the two sides of the same coin, which act more like two complementary rights promoting the rights of individuals to protect themselves and to promote the responsibility of governmental institutions. In the current situation while this academic paper is being drafted especially for this conference, the Information and Privacy Agency has managed to employee only nineteen people, through whose performance, citizens should have realistic expectations to have their rights guaranteed. Upon its transformation from the National Agency for Personal Data Protection into the Information and Privacy Agency, its mandate became wider and the authority itself got empowered being given the mechanism of imposing fines to data controllers in both public and private sector in cases of law violations, as well as to public institutions neglecting citizens’ requests to access public documents. This paper drafted especially for this nation-wide conference represents the current situation to which extent are these rights respected and challenges of the respective authority to serve citizens with in full capacity.
