Summary/Abstract: This article concerns the legal role of the President of the Republic of Poland in the process of appoint- ing the Council of Ministers under the Ordinance of the Constitution of the Republic of Poland of 2 April 1997 in the context of constitutional practice. The article deals with the competence of the President in all the modes of government formation provided for by the Constitution. The author analyses the legal and systemic relations between the President and the Sejm of the Republic of Poland in the context of procedures for the formation of the cabinet. The position of the head of state is also determined by political factors which are mentioned.
