CAN THE CRIME OF DESTROYING OR DAMAGING A MONUMENT ALSO BE A HOOLIGAN CRIME? NOTES ON THE BACKGROUND OF PRACTICE RESEARCH

Summary/Abstract: The aim of the article was to present the results of research from the review of cases concerning the destruction or damage of a monument registered in the Regional Prosecutor’s Office in Lublin. The studies covered the years 2008 - 2018, they were carried out in terms of qualifications under Art. 57a of the Penal Code or the possibility of applying such a qualification. The article introduces the problem of hooliganism in the context of the crime of destroying or damaging the monument. In particular, attention was paid to the motivation of the perpetrator of such an act, as well as the consequences of its correct determination. The subject of the considerations was also the concept of vandalism and its characteristic features.
