LIABILITY AND INSURANCE AGAINST LIABILITY FOR DAMAGES RESULTING FROM THE BUSINESS ACTIVITIES OF THE ORGANIZATIONS OF ASSOCIATED LABOUR ENGAGED IN THE DISTRIBUTION OF ELECTRIC POWER

Summary/Abstract: In civil law, the liability of enterprises in the business of distribution of electric power is multi-dimensional. It is the result of the abuse of many duties these enterprises have in performance of their business activity as well as a factor of the electric power system supplying electric power to the consumers under the provisions of the Electrical Manufacturing Industry Law and the Contract of Supply i.e. General Conditions (contractual) of Supply of Electric Power, or the result of damaged caused to the property interests and injuries inflicted to other parties (consumers etc), in the performance of their business activities, or other activities. Liability for breach of obligations for the supply of power undertaken under the Contract of Supply is regulated by the Republic or Provincial Electrical Manufacturing Industry Laws and the Contracts of Supply of Electric Power i.e. the Général Conditions (contractual) of Supply. The characteristics of this liability, which is undiisputably of the utmost social and economic significance is that it is distributed among several factors. This clearly points to the inevitable existance of the need to intensify the liability of the distributing organisations in respect of the present situation in this field. The limiting factor in the establishment of a system of liability of the distributing organisations for the orderly fulfilment of duties or obligations in the supply of power with a view to its expansion — between the intensification of that liability and the institutionalisation of objective and unlimited liability — should not be sought in the lagging behind of the development of the electrical manufacturing industry but rather in that the unity of the Yugoslav or for that matter republic electrical manufacturing system has .not been achieved in practice. Insurance against liability of the distributing organisations of electric power as it is applied today in accordance with the Uniform Yugoslav General Conditions for the Insurance Against Liability deals with the covering of liability for its offenses, and certain cases of contractual liability such as the liability for the deficient quality of supplied power if it should result in the damage or destruction of property, as well as some others, such as liability for the deficient quantity of power supplied, through supplement insurance against the so-called „clean property damages”.
