Summary/Abstract: The article discusses the problem of the off-label treatment method widely used in relation to patients and the possible criminal liability for this kind of action. The author’s conclusion is that a doctor should not be held criminally liable for this practice if they acted in a reliable manner, respecting the current medical knowledge, which is constantly evolving. In specific cases, it would be possible to apply Art. 26 and 27 of the Polish Criminal Code.
