Summary/Abstract: It is intuitive that a person should have the right to regain possession of his property that is in the unlawful possession of another. Accordingly, one indeed has this right in both Anglo-American and Continental law. While the rules in the main legal systems are similar, they are spoken about in quite differing ways; in the Anglo-American system, the focus is on the type of title, whereas in the Continental this is not usually the case. This article sets forth the basic rules in a neutral phraseology, and discusses some nuances of the laws in Anglo-American, Quebec, France, Soviet and Post Soviet, including Lithuanian, jurisdictions.
