Summary/Abstract: Right to work and employment is area of particular importance and interest for legislator, state as well as for the society as a whole and also for the citizens and legal entities that are under their legal jurisdiction. The author shall through several topics try to theoretically analyse and critically consider legislative solutions, institute and procedures from the area of protection of civil servant rights of employment as well as special category of employee whose employment-legal status is primarily regulated by the Law on Civil Servants as lex specialis. Also, the author will particularly focus on qualitative analysis of jurisprudence opinions related to practical application of protection of civil servant rights during the court proceedings, with brief reference to the jurisprudence in the Republic of Srpska, Federation of Bosnia and Herzegovina and the Republic of Serbia. Furthermore, the author shall also consider certain dilemmas related to the civil servants rights in court proceedings and analyse possible causes and reasons of such procedures of the competent court
